California Attorney General Proposes Further Revisions to CCPA Regulations

On October 12, 2020, the California Attorney General issued a notice of proposed revisions to the California Consumer Privacy Act (CCPA) enforcement regulations, along with the proposed revisions (hereinafter referred to as the "Proposed Regulations"). The Proposed Regulations include the following key points:

  1. Offline Notices: Businesses that collect consumers' personal information through offline interactions must provide offline notices to inform consumers of their right to opt-out of the sale of their personal information (hereinafter referred to as "opt-out"). Additionally, businesses collecting personal information over the phone may provide the required notice orally during the same call in which the information is collected.

  2. User-Friendly Opt-Out Mechanisms: Businesses must ensure that the opt-out mechanisms they provide to consumers are easy to use and minimize the steps required for consumers to exercise their opt-out rights. For example, businesses must not use confusing language (such as double negatives) or require consumers to read through their entire privacy policy or similar documents or webpages before taking action to opt-out.

  3. Verification of Authorized Agents: The Proposed Regulations clarify how businesses may verify the identity of consumers who submit requests to know or delete personal information through authorized agents. Specifically, businesses may require the authorized agent to provide written proof that the consumer has given written authorization for the agent to act on their behalf.

  4. Minor-Specific Provisions: The Proposed Regulations specify that businesses subject to certain provisions, including those related to obtaining parental or guardian consent for the sale of personal information of consumers under 13 years old and obtaining consent for the sale of personal information of consumers aged 13 to 15, must include information about these minor-specific provisions in their privacy policies.
